1. Terms of use of INDELAGUE

1.1 Any use of this Website provided by INDELAGUE - Indústria Eléctrica de Águeda, SA is subject to these Terms of Use. These Terms of Use may be amended, modified or replaced by other terms and conditions, eg. for the purchase of products and services. With log-in, or where it is not necessary to log-in to access or use the Web Site INDELAGUE, accepted these Terms of Use in their current version.

1.2 If the User use this WebSite INDELAGUE under his trade, business or profession, shall not apply the Laws of Consumer Protection.

2. Services

2.1 This Website of INDELAGUE contains specific information and software, as well related documentation, for viewing or downloading.

2.2 The INDELAGUE may discontinue all or part of the running of the Webpage at any time. Due to the nature of the internet and computer systems, INDELAGUE assumes no liability for the continuous availability of the Website INDELAGUE

3. R egistration, Password

3.1 Some pages of the WebSite INDELAGUE can be protected with a password. In the interest of security of business transactions, only registered Users may access to that pages. The INDELAGUE reserves the right to deny registration to any User. 4.3 Software should be made available at no expense in executable code. There will be no right to release the source code. This shall not apply to source code related to open source software, which license conditions take priority over these Terms of Use in the case of transmission of open source software whose conditions require the available of the source code. In this case, INDELAGUE will provide the source code upon the payment of costs.

4.4 The information, software and documentation may not be distributed by the User to any third party at any time nor may it be rented or in any other way made available. Unless such is allowed by law, the User shall not modify the software or documentation nor shall it disassemble, reverse engineer or desegregate the software or separate any of its parts. The User may make one backup copy of the software where necessary to secure further use in accordance with these Terms of Use.

The User shall comply with such laws and in particular shall not modify, conceal or remove any alphanumeric code, marks or copyright notices of the information, software or documentation, or any copies of any of them.

5. Intellectual Property

8.1 The INDELAGUE responsibility for defects in relation to quality and title shall be determined in accordance with the provisions of Section 8 of these Terms of Use. Any further liability of INDELAGUE is excluded unless required by law, for example under the Law on Product Liability in case of wilful misconduct, gross negligence, personal injury or death, failure to meet guaranteed characteristics, fraudulent concealment of a defect or in case of breach of fundamental contractual obligations. The damages in case of breach of fundamental contractual obligations is limited to the foreseeable damage typical of the contract, there is no wilful misconduct or gross negligence.
